Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions for using the services (hereinafter referred to as the “Services”) provided on this website by Ooshimaya Co., Ltd. (hereinafter referred to as the “Company”). All registered users (hereinafter referred to as “Users”) shall use the Services in accordance with these Terms.


Article 1 (Application)

These Terms shall apply to all relationships between the User and the Company regarding the use of the Services.

In addition to these Terms, the Company may establish individual rules and other provisions for the use of the Services (hereinafter collectively referred to as “Individual Provisions”). These Individual Provisions shall constitute part of these Terms regardless of their titles.

If there is any inconsistency between the provisions of these Terms and the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified.


Article 2 (User Registration)

Registration is completed when a prospective user agrees to these Terms, applies for registration via the method specified by the Company, and the Company approves the application.

The Company may refuse to approve a registration application if it determines that the applicant falls under any of the following, and is not obligated to disclose the reasons:

  • False information provided in the registration;

  • The applicant has violated these Terms in the past;

  • The Company deems the registration inappropriate for any other reason.


Article 3 (User ID and Password Management)

Users shall manage their user ID and password for the Services responsibly.

Users must not transfer, lend, or share their user ID and password with third parties under any circumstances. If a login occurs with matching credentials, it is deemed to be used by the registered user.

The Company shall not be liable for any damages arising from the use of a user ID and password by a third party unless caused by the Company's intentional misconduct or gross negligence.


Article 4 (Usage Fees and Payment)

Users shall pay the usage fees for paid Services as displayed on the website via the method specified by the Company.

If a User delays payment, they shall be subject to a late fee of 14.6% per annum.


Article 5 (Prohibited Conduct)

Users shall not engage in the following acts while using the Services:

  • Violations of laws or public order and morals

  • Criminal activities

  • Infringement of intellectual property rights included in the Services

  • Disruption of servers or networks used by the Company or others

  • Commercial use of information obtained through the Services

  • Activities that may interfere with the operation of the Company’s Services

  • Unauthorized access or attempts thereof

  • Collection or storage of personal information of other users

  • Use of the Services for unlawful purposes

  • Actions that cause disadvantage, damage, or discomfort to other users or third parties

  • Impersonation of other users

  • Unauthorized advertising or solicitation on the Services

  • Activities aimed at meeting strangers of the opposite sex

  • Providing benefits to antisocial forces

  • Any other acts deemed inappropriate by the Company


Article 6 (Suspension of Services)

The Company may suspend or interrupt the Services without prior notice if:

  • System maintenance or updates are needed

  • Services cannot be provided due to force majeure such as natural disasters

  • System failures or communication outages occur

  • The Company deems it difficult to continue providing the Services

The Company is not liable for any damages caused by such suspensions or interruptions.


Article 7 (Usage Restrictions and Deregistration)

The Company may restrict or delete a User’s account without prior notice if:

  • The User violates any Terms

  • False information is found in the registration

  • Payment obligations are not fulfilled

  • The User is unresponsive to contact for a certain period

  • The User has not used the Services for a certain period

  • The Company determines the use of Services to be inappropriate

The Company shall not be liable for any damages resulting from such actions.


Article 8 (Withdrawal)

Users may withdraw from the Services according to the Company’s specified procedure.


Article 9 (Disclaimer of Warranty and Liability)

The Company makes no warranties, express or implied, regarding the Services' safety, accuracy, reliability, effectiveness, or fitness for a particular purpose.

The Company shall not be liable for any damages incurred by Users unless caused by the Company's willful misconduct or gross negligence. However, if a consumer contract under the Consumer Contract Act is formed, such disclaimers do not apply.

Even in such cases, the Company shall not be liable for any special damages foreseeable by either party or beyond the paid amount for the month in which the damage occurred.

The Company is not responsible for disputes or transactions between Users or third parties.


Article 10 (Changes to Service Content)

The Company may change, add, or discontinue the Services with prior notice to Users.


Article 11 (Revisions to Terms)

The Company may revise these Terms without individual User consent if:

  • The changes are in the general interest of Users;

  • The changes are reasonable in view of the necessity, nature, and impact of the change.

The Company shall notify Users of changes and their effective date in advance.


Article 12 (Handling of Personal Information)

Personal information obtained through the use of the Services shall be handled appropriately in accordance with the Company's [Privacy Policy].


Article 13 (Notices and Communication)

Notices between Users and the Company shall be made via methods designated by the Company. Notices to a User’s registered contact information shall be deemed delivered upon transmission.


Article 14 (Prohibition on Assignment of Rights and Obligations)

Users may not transfer or pledge their status under the Service agreement or their rights or obligations under these Terms to any third party without prior written consent from the Company.


Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan.

Any disputes arising from or in connection with the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company’s head office.
